Welcome to CarryCast™. These Terms of Service (“Terms”) govern your access to and use of the CarryCast website, products, and related services (collectively, the “Services”).
CarryCast is based in Fernie, British Columbia, Canada.
By accessing our website, placing an order, or otherwise using our Services, you agree to these Terms. If you do not agree to these Terms, please do not use our Services.
1. Eligibility and Use of Our Website
You must be at least the age of majority in your province, state, or jurisdiction of residence to make a purchase through our website, or you must have the permission and supervision of a parent or legal guardian.
You agree not to use our website or Services for any unlawful, fraudulent, abusive, or unauthorized purpose.
You must not attempt to interfere with the security, functionality, or operation of our website or use our Services in a manner that violates applicable laws or the rights of others.
2. Product Information
We make reasonable efforts to provide accurate product descriptions, specifications, photographs, pricing, and other information.
However, product colors, finishes, packaging, accessories, and other details may vary slightly from photographs or descriptions due to manufacturing changes, product improvements, screen displays, or other factors.
We reserve the right to correct errors, inaccuracies, or omissions and to update product information at any time.
We may modify or discontinue products without notice, subject to applicable law.
3. Orders and Acceptance
Submitting an order does not necessarily mean that we have accepted it.
We reserve the right, to the extent permitted by law, to refuse, limit, or cancel an order for reasons including:
- Product unavailability;
- Pricing or listing errors;
- Suspected fraud or unauthorized transactions;
- Incorrect shipping or payment information;
- Abuse of promotions, discounts, refunds, or guarantees; or
- Other circumstances that reasonably prevent us from fulfilling the order.
If we cancel an order after payment has been processed, we will issue an applicable refund.
We may also limit quantities purchased per person, household, account, payment method, or order where reasonably necessary.
4. Pricing and Payment
Prices are displayed in the currency indicated on the website, including CAD and USD where available.
Prices, promotions, discounts, and product availability may change without notice.
Applicable taxes, shipping charges, duties, or other fees will be displayed or calculated where applicable.
Payments are processed through third-party payment providers. By submitting payment information, you represent that you are authorized to use the selected payment method.
You agree to provide accurate and current billing, shipping, contact, and payment information.
5. Promotions, Discounts and Special Offers
From time to time, CarryCast may offer promotional pricing, discount codes, bundles, gifts with purchase, free products, free shipping, or other special offers.
Unless otherwise stated:
- Promotions are available for a limited time;
- Promotions cannot be combined with other offers;
- Discount codes have no cash value;
- Promotions may be subject to product, geographic, inventory, or order-value restrictions;
- Free gifts or promotional items are available while supplies last; and
- We may modify or discontinue promotions at any time, subject to applicable law.
If an order is returned or refunded, promotional items or discounts associated with that purchase may affect the amount eligible for refund as described in our Refund Policy and applicable law.
6. Shipping and Delivery
We aim for orders within Canada and the United States to arrive approximately 5–7 business days after ordering under standard shipping conditions.
Orders placed before 1:00 PM Eastern Time on business days are typically processed the same business day. Orders placed after the cutoff, on weekends, or on holidays are typically processed the next business day.
These timeframes are estimates and are not guaranteed.
Delivery may be affected by factors outside our reasonable control, including courier delays, severe weather, customs processing, incorrect addresses, peak shipping periods, carrier disruptions, and other unforeseen circumstances.
Expedited shipping options may be available at checkout for an additional charge.
Customers are responsible for providing a complete and accurate shipping address. Additional charges resulting from incorrect or incomplete address information may be the customer's responsibility where permitted by law.
Risk of loss and title will transfer as provided by applicable law.
7. Returns, Refunds and 90-Day Guarantee
CarryCast offers a 90-day risk-free guarantee on eligible purchases.
If you are not satisfied with an eligible CarryCast product, you may request a refund within 90 days of receiving your order, subject to the conditions of our Refund Policy.
To initiate a return or refund request, contact support@carrycast.com with your order information.
Certain circumstances, including suspected fraud, abuse of the guarantee, or purchases outside the applicable guarantee period, may not qualify.
Any statutory consumer rights available to you under applicable law are not affected by this guarantee.

8. Product Use and Safety
CarryCast products are intended to be used responsibly and for their intended recreational purposes.
Fishing and outdoor recreation involve inherent risks, including risks associated with hooks, fishing line, water, weather, terrain, wildlife, transportation, and other environmental conditions.
You are responsible for:
- Using products appropriately and according to any instructions or warnings provided;
- Inspecting equipment before use;
- Following applicable fishing, boating, and outdoor safety rules;
- Complying with local fishing licenses, regulations, and laws;
- Supervising children and inexperienced users appropriately; and
- Exercising reasonable judgment regarding weather, water conditions, wildlife, and other outdoor hazards.
CarryCast products should not be used in circumstances that exceed their intended design or capabilities.
Nothing in these Terms excludes liability that cannot legally be excluded under applicable consumer protection or other laws.
9. Intellectual Property
The CarryCast name, trademarks, logos, website content, photographs, videos, graphics, text, designs, advertising materials, and other brand assets are owned by or licensed to CarryCast and are protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, sell, license, commercially exploit, or otherwise use our intellectual property without prior written permission, except as permitted by applicable law.
10. Reviews, Comments and User-Generated Content
If you submit reviews, photographs, videos, comments, testimonials, suggestions, or other content to CarryCast, you represent that you have the right to provide that content.
You grant CarryCast a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, adapt, and publish that content in connection with our business, products, website, advertising, and marketing, subject to applicable law.
This license does not transfer ownership of your content to CarryCast.
You may not submit content that is unlawful, infringing, deceptive, abusive, defamatory, obscene, or otherwise violates the rights of another person.
We reserve the right to moderate or remove user-generated content where permitted by law.
11. Third-Party Services and Links
Our website may integrate with or contain links to third-party services, websites, applications, payment providers, social networks, or other platforms.
Third-party services are governed by their own terms and privacy practices.
CarryCast is not responsible for third-party websites, services, content, or practices to the extent permitted by applicable law.

Your use of our Services is also subject to our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.

13. Disclaimer of Warranties
To the fullest extent permitted by applicable law, our website and Services are provided on an “as available” basis.
We do not guarantee that our website will always be uninterrupted, error-free, secure, or available.
Any warranties, guarantees, or consumer rights that cannot legally be excluded or limited remain in effect.
Nothing in these Terms is intended to limit rights you may have under applicable consumer protection laws.
14. Limitation of Liability
To the fullest extent permitted by applicable law, CarryCast and its directors, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of our Services or products.
This may include, where legally permitted, losses arising from loss of profits, loss of data, business interruption, or similar economic losses.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law, including any liability that cannot legally be waived under applicable consumer protection legislation.
15. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless CarryCast and its directors, officers, employees, contractors, and affiliates from third-party claims, damages, liabilities, and reasonable expenses arising from your unlawful misuse of our Services, your material breach of these Terms, or your violation of another person's rights.
16. Fraud, Abuse and Chargebacks
We reserve the right to investigate suspected fraudulent transactions, misuse of promotional offers, refund abuse, or other activity reasonably believed to violate these Terms.
If you believe a charge is incorrect, please contact support@carrycast.com so we can attempt to resolve the issue.
Nothing in these Terms limits any lawful rights you may have to dispute an unauthorized or incorrect transaction with your payment provider.
17. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Where permitted by applicable law, disputes arising from these Terms or the Services will be subject to the jurisdiction of the courts of British Columbia.
Nothing in this section deprives consumers of mandatory rights or protections available under the laws of their place of residence where those rights cannot legally be waived.
18. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
19. No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.
20. Changes to These Terms
We may update these Terms periodically to reflect changes to our Services, business practices, or legal requirements.
When we make changes, we will update the “Last updated” date at the top of this page.
Your continued use of the Services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
